Terms of Use

Last Updated: November 1, 2025

The Short Version

Be reasonable. Don't abuse the free scanner. Don't try to hack the site. If you hire me for work, we'll have a separate contract. These terms cover using this website and the free accessibility scanner.

Agreement to Terms

By accessing or using this website, you agree to these Terms of Use. If you don't agree, don't use the site. Simple as that.

What This Website Offers

This website provides:

  • Free accessibility scanning - A tool to check your website for common accessibility violations
  • Educational content - Blog posts and guides about website accessibility and ADA compliance
  • Contact forms - Ways to request consultations or ask questions
  • Information about services - Details about professional accessibility remediation services

Using the Free Accessibility Scanner

What You Can Do

  • Scan websites you own or have permission to scan
  • Use scan results to understand accessibility issues
  • Run reasonable numbers of scans for legitimate purposes

What You Can't Do

  • Abuse the scanner - Don't run hundreds of scans in rapid succession or use automated tools to overwhelm the service
  • Scan sites you don't own - Without permission from the site owner
  • Resell scan results - This is a free tool for your use, not a service you can rebrand and resell
  • Reverse engineer - Don't try to figure out how the scanner works to copy it
  • Use for malicious purposes - Don't use scan results to threaten, harass, or harm others

Scanner Limitations

The free scanner:

  • Checks for common accessibility violations, not every possible issue
  • Provides general guidance, not legal advice or a guarantee of full compliance
  • May have false positives or miss issues (automated scanning has limits)
  • Doesn't guarantee your website will pass every accessibility standard

Bottom line: The scanner is a helpful starting point, not a comprehensive audit or legal shield.

No Warranties

This website and the free scanner are provided "as is" without warranties of any kind.

I don't guarantee that:

  • The scanner will catch every accessibility issue
  • The website will always be available (though I try)
  • All information on the site is 100% accurate
  • Using the scanner will prevent lawsuits or guarantee compliance

The scanner is a tool to help identify issues. It's not a replacement for professional accessibility auditing or legal advice.

Limitation of Liability

I'm not liable for any damages that result from using (or not being able to use) this website or scanner, including:

  • Lost business or revenue
  • Legal issues or lawsuits related to accessibility
  • Data loss (though I don't store much data anyway - see the Privacy Policy)
  • Indirect, incidental, or consequential damages

Translation: Use the free scanner to learn about your site, but don't rely solely on it for legal compliance. If you need comprehensive accessibility remediation, hire me (or someone qualified) for professional services.

Professional Services

If you hire me for professional accessibility remediation services, we'll enter into a separate written agreement that supersedes these Terms of Use for that specific work.

That agreement will cover:

  • Scope of work
  • Timeline
  • Payment terms
  • Deliverables
  • Warranties specific to the paid work

These Terms of Use apply to using the website and free scanner, not to paid professional services.

Not Legal Advice

Important: Nothing on this website constitutes legal advice.

The blog posts, guides, and information provided are educational resources about website accessibility. They are not:

  • Legal advice specific to your situation
  • Guaranteed to be 100% current or accurate
  • A substitute for consulting with a lawyer

If you've received an ADA demand letter or have specific legal questions, consult with an attorney who specializes in ADA defense.

Intellectual Property

All content on this website - text, design, code, graphics, logos - is owned by me unless otherwise noted.

You may:

  • Read and share blog posts (with attribution)
  • Link to pages on this site
  • Quote small portions of content (with attribution)

You may NOT:

  • Copy entire blog posts or pages
  • Steal the design or code
  • Use my content to create competing services
  • Remove copyright or attribution notices

Links to Other Websites

This site may contain links to third-party websites. I'm not responsible for:

  • The content on those sites
  • Their privacy practices
  • Any damages from visiting those sites

If I link to a website, it doesn't mean I endorse everything on it. Use common sense when clicking external links.

Privacy

Your use of this website is also governed by the Privacy Policy. Please read it to understand how I handle your information.

Short version: I don't sell your data, I don't spam you, and I only contact you if you ask me to.

Termination

I reserve the right to:

  • Block access to the scanner if you're abusing it (running thousands of scans, for example)
  • Refuse service to anyone for any reason (though I won't be arbitrary about it)
  • Modify or discontinue the free scanner at any time

If I need to block your access, I'll try to contact you first unless you're clearly doing something malicious.

Changes to These Terms

I may update these Terms of Use from time to time. When I do, I'll update the "Last Updated" date at the top.

If there are significant changes, I'll post a notice on the website. Continuing to use the site after changes means you accept the updated terms.

Governing Law

These Terms of Use are governed by the laws of the State of Texas, without regard to conflict of law principles.

Any disputes will be resolved in the state or federal courts located in Harris County, Texas.

Severability

If any part of these Terms is found to be unenforceable, the rest of the Terms remain in effect.

The Common Sense Clause

Look, I wrote these terms to protect both of us and set reasonable expectations. But fundamentally:

  • Be reasonable
  • Don't abuse the free tools
  • Don't try to sue me because an automated scan missed something
  • If something seems unclear, just ask

I'm a solo developer trying to help businesses with accessibility. Let's keep this simple and professional.
